RV Pass - Membership Terms and Conditions (New Zealand)

1.        General

1.1      This document sets out the terms and conditions that apply to your RV Pass Membership (“Terms and Conditions”).

1.2      By completing an RV Pass membership form (“Membership Form”), you acknowledge that a copy of these Terms and Conditions were made available to you and that you have read, accepted and agreed to be bound by them.

1.3      If you are under 18 years of age, then you are not eligible for an RV Pass Membership. 

1.4      The RV Pass programme excludes campervan, motorhome, caravan or camper-trailer purchases, unless stated otherwise.

1.5      The allocation, redemption, value and terms of use for RV Pass Points will be determined by us in our absolute discretion and may be updated or changed from time to time. 

 

2.    Definitions

2.1      In these Terms and Conditions, references to ‘RVSC’, ‘us’,  ‘we’ and ‘our’ is a reference to Tourism Holdings Ltd, trading as RV Super Centre and a reference to ‘you’ and ‘your’ is a reference to you, an RV Pass Member.

2.2      In these Terms and Conditions, the following terms will have the following meanings:

“RV Pass Points” means points earned by an RV Pass Member in accordance with clause 5;

“RV Pass” means the rewards programme offered by RVSC;

“RV Pass Member” means you, a customer of the RV Super Centre who has become a member of the RV Pass programme;

“RV Pass Membership” means membership of the RV Pass programme, which is governed by these terms and conditions.

 

3.    Term 

Your RV Pass Membership starts on the date we accept your completed Membership Form, and continues until terminated in accordance with clause 8.

 

4.    Your RV Pass Membership

4.1      As an RV Pass Member, you may earn RV Pass Points when purchasing products in-store or online.  These RV Pass Points can then be used in relation to purchases at Redemption Outlets.  

4.2      In addition, as an RV Pass Member, you are entitled to the following benefits (“Benefits”):

(a)      Promotions only redeemable by RV PASS members;

 

5.    Earning RV Pass Points

5.1      Subject to clause 5.1, you will earn 1 RV Reward Point for every $50 spent at the RV Super Centre or associated outlets offering RV Pass up to 24^th January 2019.

5.2      Beyond 24^th January 2019, RV Super Centre or associated outlets will no longer issue points based on 1 point for every $50 spent as standard practice. Existing points are still redeemable subject to clause 5.5 and 5.6.

5.3      RV Pass Points may be issued for any reason at the sole discretion of RV Super Centre or associated outlets.

5.4      RV Pass Points earned on any day will be credited to your Account within the next seven business days.

5.5      RV Pass Points earned by you are valid for twelve months from the date of issue and will then expire.

5.6      If you return a purchase, the RV Pass Points earned for the original purchase (including any bonus RV Pass Points) will be reversed. 

 

6.    Redeeming your RV Pass Points

6.1      1 RV Reward Point equals $1 which can be redeemed against eligible purchases at any RV Super Centre in-store, online at www.rvsupercentre.co.nzor at other associated outlets (together, “Redemption Outlet”).

6.2      We will deduct RV Pass Points which you have redeemed from your RV Pass Points balance.

6.3      You may not sell or transfer your RV Pass Points or convert them into cash.

 

7.    Cancellation and Termination

 

Cancellation by you

7.1      You may cancel your RV Pass Membership at any time by notifying us by telephone, email, or in person with proof of ID. 

7.2      Provided you have not acted fraudulently, any RV Pass points earned by you can be redeemed within ten business days of cancellation, after which date any unused RV Pass points will become void.

 

Cancellation by us

7.3      If you fail to comply with these Terms and Conditions, operate fraudulently, or otherwise abuse the accumulation or redemption of RV Pass Points, we may cancel your RV Pass Membership, or freeze your RV Pass Membership while the matter is investigated.

7.4      If we cancel your RV Pass Membership in accordance with clause 7.3, you will not be eligible to redeem any RV Pass Points previously earned. 

7.5      If we freeze your RV Pass Membership in accordance with clause 7.3, you will not be eligible to redeem any RV Pass Points previously earned on your account while your account is frozen and matters are investigated.

7.6      We may terminate the RV Pass programme at any time without prior notice. If this occurs, we will allow at least three months for the redemption of unused RV Pass Points. 

 

8.    Communication

8.1      You consent to receiving communications from us electronically, with the option to opt-out at any time. 

8.2      We will communicate with you by email or by posting notices on our website www.rvsupercentre.co.nz. 

 

9.    Disputes

9.1      If you have any dispute relating to earning or redeeming RV Pass Points (including your RV Pass Points balance) (“Dispute”) please notify us in writing (“Dispute Notice”).

9.2      We will investigate any Dispute and advise you of the outcome within 20 business days of receiving your Dispute Notice.

9.3      If the investigation is not completed within 20 business days, we will advise you of the reason for the delay.

9.4      Where it is established that an error occurred (regardless of whether it was to do with the original Dispute) it will be corrected, and you will be advised of any appropriate adjustments which will be made to your RV Pass Points balance.

9.5      Any disputes relating to the quality or suitability of any goods or services provided by any Redemption Outlet must be resolved directly through the relevant Redemption Outlet. 

 

10.  Variation

We reserve the right to vary these Terms and Conditions in our absolute discretion, by posting notice on our website www.rvsupercentre.co.nz.

 

11.  No Transfer

The Benefits and points you receive under your RV Pass Membership are personal to you and cannot be transferred, gifted, exchanged for cash or sold to another person.

 

12.  Privacy

We may collect, hold, use and disclose your personal information collected in relation to the RV Pass in accordance with our Privacy Policy which can be found here.

 

13.  Governing Law

These Terms and Conditions are governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the courts of New Zealand in respect of any dispute or proceeding arising out of these Terms and Conditions.
